You are eligible to submit a Claim Form if you are a member of the Collection Letter Class.

You are a Collection Letter Class Member if you are a natural person who:

  1. At any point between September 6, 2014 and June 25, 2018, resided in any of the properties in North Carolina owned and/or managed by Defendants, and
  2. You received a letter that threatened that NRP would file a summary ejectment lawsuit, eviction action, or notice to vacate the premises if you failed to make a complete rental payment and that once the summary ejectment lawsuit was filed, you would be charged Eviction Fees in order to dismiss the eviction action. You may be a member of both the Collection Letter Class and the Eviction Fee Class. If so, then you are automatically eligible to participate in the Settlement and obtain Eviction Fee benefits without filing a Claim Form. You must submit a Claim Form if you want to obtain Collection Letter benefits as well.

If you fill out a valid and timely Claim Form and declare under penalty of perjury that you received a Collection Letter, you are eligible to receive up to $50.00. However, you may be eligible to receive up to $150.00 if you certify under the penalty of perjury that you received more than one Collection Letter and in Section B provide dates when those Collection Letters were received. To qualify for the maximum award amount, you must provide information about three received Collection Letters.

Please note that none of these benefits will be distributed or available until the Settlement is finally approved by the Court.

If you submit a valid and timely Claim Form, the amount you actually receive may be significantly reduced depending on how many valid claims are ultimately submitted by other Class Members. The available Settlement Fund will be distributed on a proportional basis once the Settlement becomes final. The Collection Letter Class has been allotted $50,500 of the Settlement Fund. The exact amount of compensation will be determined after administrative expenses, service award, and attorneys’ fees and costs are deducted.

All Claims are subject to verification.
